Terms of Service for CitaMente

These Terms contain a limitation of our liability and an important disclaimer about AI-generated information and appointment reminders. Please read Sections 4, 5, and 11 carefully.
When you create an account or use CitaMente (the “Service”), you are agreeing to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Service.
We may not always exercise or enforce a right or provision of these Terms; that does not mean we have waived it.
1. Account Terms
- You must be at least 18 years old to create an account. If you are between 14 and 17, you may only use the Service with the authorization of a parent or legal guardian, who accepts these Terms on your behalf. We do not knowingly create accounts for children under 14.
- You are responsible for keeping your account credentials secure. We cannot and will not be liable for any loss or damage arising from your failure to keep them secure.
- You are responsible for all activity that occurs under your account, including content added by you or by other members of a family group you create or join.
- You must provide a valid email address. We use it to verify your account, to let you reset your password, and to contact you about the Service.
- You must be a human. Accounts created by automated methods are not permitted.
2. Acceptable Use
- Do not use the Service for any unlawful purpose, or to store or transmit content that violates the rights of others.
- Do not attempt to gain unauthorized access to the Service, other users’ accounts, or our infrastructure.
- Do not use the Service to store information about another person without their knowledge and authorization (see Section 6).
- We may suspend or terminate an account that violates these Terms.
3. What CitaMente Is — and Is Not
- CitaMente helps you record, organize, and be reminded of medical appointments. It is an organizational tool.
- CitaMente does not provide medical advice, diagnosis, or treatment. Nothing in the Service is a substitute for professional medical judgment. Always follow the instructions given to you by your healthcare provider.
- We are not a healthcare provider, we are not affiliated with your clinic or physician, and we do not schedule, confirm, modify, or cancel appointments with any provider on your behalf. Recording an appointment in CitaMente does not create, change, or cancel anything with your clinic.
- We do not verify that the appointments recorded in the Service are real, current, or correct.
4. AI-Generated Information and Accuracy
This section describes a real and known limitation of the Service. Please read it.
- CitaMente uses automated systems, including third-party artificial intelligence services, to transcribe voice recordings and to extract appointment details from photographs of medical documents and from text you enter.
- These systems make mistakes. They can misread a date, a time, a doctor’s name, an address, or an instruction. They can omit information that was present, and they can produce information that was not.
- You are responsible for reviewing the extracted information before saving it, and for verifying it against your original document, appointment card, or your provider directly. The Service shows you the extracted data for review precisely so that you can correct it.
- A confidence score shown in the Service is an estimate produced by the same automated systems. A high score is not a guarantee of accuracy.
- We are not responsible for a missed, late, or incorrectly attended appointment resulting from information that was extracted, transcribed, or interpreted incorrectly.
5. Reminders
- Reminders are a convenience. They are provided on a best-effort basis and are not guaranteed.
- Delivery of a reminder depends on things outside our control, including your device’s settings and permissions, network availability, battery optimization, and third-party push notification infrastructure.
- A reminder may arrive late, may arrive more than once, or may not arrive at all. A reminder is scheduled from the date, time, and timezone recorded for the appointment; if any of those are wrong, the reminder will be wrong.
- You remain responsible for attending your appointments. Do not rely on CitaMente as your only means of remembering them.
6. Family Groups and Other People’s Information
- The Service allows you to create or join a family group, and to record appointments for, or assign appointments to, other members of that group.
- Health information is sensitive personal data (“dato sensible”) under Colombian law. By recording or assigning an appointment that concerns another person, you confirm that you have that person’s authorization to do so, or that you are their parent or legal guardian and may authorize it on their behalf.
- Members of a family group can see the appointments of other members of that group. Do not join a family group with people you are not willing to share this information with, and do not add information about someone who has not agreed to it.
- If you leave a family group, appointments you created may remain visible to the remaining members.
- You are responsible for the information you enter about other people. If someone asks us to remove information about them that you entered, we may do so.
7. Your Content
- You keep ownership of the content you put into the Service — your recordings, photographs, notes, and appointment data.
- You grant us the limited permission needed to operate the Service: to store your content, to transmit it to the third-party providers described in our Privacy Policy so that it can be transcribed and structured, and to display it back to you and to the family group members you have shared it with.
- We do not sell your content, and we do not use it to advertise to you.
8. Cancellation and Termination
- You may delete your account at any time from within the Service.
- When you delete your account, your personal data is handled as described in our Privacy Policy. Some records may be retained where we are required to keep them by law.
- We may suspend or terminate your account if you violate these Terms, or if we are required to by law.
- We may discontinue the Service. If we do, we will give you reasonable notice and an opportunity to retrieve your data where practicable.
9. Modifications to the Service
- We may add, change, or remove features. Some changes may make the Service less useful to you; if that happens, you may delete your account.
- We may impose limits on storage, uploads, or processing where necessary to keep the Service running for everyone.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what personal data we collect, why, who processes it, where it goes, and how you exercise your rights under Ley 1581 de 2012.
11. Limitation of Liability
- The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
- To the fullest extent permitted by Colombian law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of health outcomes, missed appointments, loss of data, or loss of profits, arising from your use of or inability to use the Service.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Colombian consumer protection law (Ley 1480 de 2011), including liability for willful misconduct or gross negligence.
12. Governing Law and Disputes
- These Terms are governed by the laws of the Republic of Colombia.
- Any dispute arising from these Terms or from your use of the Service will be subject to the competent courts of Colombia.
- Nothing here limits your right to bring a complaint before the Superintendencia de Industria y Comercio (SIC).
13. Changes to These Terms
- We may update these Terms. When we make material changes, we will update the version number and the “Last Updated” date above, and we will notify you in the app.
- We record which version of these Terms you accepted and when. Continued use of the Service after a material change may require you to accept the new version.
